Andrew R. McCumber, a Martindale Hubbell “AV” rated lawyer,  is a founding partner of McCumber, Daniels, Buntz, Hartig & Puig, P.A. and practices from the firm’s Tampa office.  His areas of practice include nursing home, hospital, and physician malpractice defense litigation, general insurance defense litigation and civil trial practice in state and federal courts including the United States Supreme Court.

A graduate of Duke University, where he received a Bachelor of Arts degree in 1986, Mr. McCumber earned a Juris Doctor from the University of Florida College of Law in 1991, and has practiced from the Tampa Bay area ever since.  

In addition to his active trial practice, Mr. McCumber was a defense attorney advisor to Florida Lt. Governor Frank Brogan’s Task Force on the Availability and Affordability of Long-Term Care, and testified in December 2000 before a legislative panel on pending liability recommendations. Mr. McCumber was the Defense Attorney Advisor and Lead Legislative Draftsman for the Florida Health Care Association on tort reform issues during the 2001 Florida Legislative Session.  He testified again as an expert practitioner during Legislative hearings on the need for tort reform in 2004.   In 2010, Mr. McCumber testified in front of Florida State Senate’s Judiciary Committee on behalf of the Florida Health Care Association regarding Senate Bill (SB) 2034.  

He has been published in the Florida Bar Journal and has served as a presenter at various state and national conferences, including the Annual Conferences of the American Society of Health Care Risk Management, American Healthcare Association, Florida Health Care Association, Florida Association of Homes for the Aging, Assisted Living Federation of America, National Investment Centers’ LTC 100, and the Florida Long-Term-Care Defense Group.

He co-authored a chapter in the American Health Lawyers Association’s Long Term Care Handbook on regulatory, operational and financial guideposts. He has presented to continuing legal education seminars and was selected to present the defense perspective on nursing home litigation at the 2003 Annual Business Program of the Florida Conference of Circuit Court Judges.  

Mr. McCumber continues to serve as Tort Counsel to Florida Health Care Association.  He was selected by LeadingAge Florida to serve as Florida’s Representative on LeadingAge’s National Legal Committee.  In 2012, Mr. McCumber was recognized as a Best Lawyer in America, and in 2011 was honored as a Florida Super Lawyer in the practice area of medical malpractice defense.  He was also recognized by his peers as one of Florida Trend Magazine’s “Legal Elite” in civil trial practice in 2005, 2006 and 2007.
