McCumber Daniels attorney Andrew McCumber successfully defended the appeal of a trial court order that granted summary judgment in favor of defendants who provided consultant pharmacy services to a long-term care facility. The plaintiff alleged that the consultant pharmacist undertook a duty to the resident of the facility and breached that duty, resulting in the injury and death of the resident. The trial court granted final summary judgment in favor of the defendants, finding that the defendants owed no legal duty of care to the resident. On June 10, 2008, the Fifth District Court of Appeal agreed and affirmed the trial court’s order. The appellate court cited to a decision from another appellate court that recently reached the same conclusion.
