McCumber Daniels Wins Complete Defense Verdict on Behalf of Hospital

Shareholder Elaine Ross and Partner Edward Stolarski of McCumber Daniels’ Philadelphia area office won a complete defense verdict on behalf of a regional hospital, following a six day trial in a wrongful death medical negligence case in the Court of Common Pleas of Chester County.  The case involved the allegation that physicians and the hospital’s nursing staff were negligent for failing to timely report and identify lab results which the plaintiff contended would have shown that the patient had an infection.  Plaintiff argued that if this infection was discovered it could have been successfully treated with antibiotics.

Ms. Ross and Mr. Stolarski presented experts in the fields of internal medicine and infectious diseases who explained to the jury that the medical staff’s actions complied with the standard of care and that the plaintiff’s theory of the cause of death was not supported by the medical evidence.  The jury unanimously found in favor of the hospital, its nursing staff and the physician, delivering their verdict after only hour after deliberations began.
